1. GENERAL TERMS FOR PHOTOGRAPHY SESSION 

This agreement constitutes an order for wedding photography and videography services, including the taking of wedding pictures and videos as agreed to both parties. Unless otherwise specified, it is understood that any and all rights to proofs, final or sample prints and footage, thereof shall remain property of Jason J. Aguilar and may be used for advertising, display or any other purpose thought proper by Jason J. Aguilar. This signed contract constitutes an order for photography in the form of high-resolution images in digital format and videography in the form of video in digital format (MP4). There are no oral or other agreements of the parties hereto and this Contract constitutes full and complete understanding and agreement between Jason J. Aguilar and the Client. 

 

2. LIMIT OF LIABILITY 

If the photographer, Jason Aguilar, cannot perform this agreement in whole or in part due to any casualty, or nature or terror or any other cause beyond the control of the parties or due to the photographer’s illness or injury, then Jason Aguilar will return all fees to the Client(s) but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that photo and video materials are damaged in processing, lost through camera malfunction, lost in mail, or otherwise lost or damaged with fault on the part of photographer. Client(s) agrees that an entire wedding cannot be replicated, reenacted or repeated for the purpose of a re-shoot and limits Jason Aguilar’s liability to the amount paid under this contract. In the event of an extenuating circumstance on Jason J. Aguilar’s part, Jason J. Aguilar will reimburse the full amount paid to the customer, including the deposit.

3. RESERVATION DEPOSIT & PAYMENT SCHEDULE 

One-third of the package cost is needed for deposit to secure your date and time of wedding. The deposit is non-refundable in the event of cancellation or date change if Jason J. Aguilar is not contacted within 30 days of the reserved day and time. A second down payment is due at engagement session or one month prior to the wedding date. Remaining balance is due on or before the wedding date. 

 

4. TRAVEL FEE 

There is a $40 travel fee for portrait sessions located 30 miles outside of Sanford, North Carolina. $60 travel fee for 60 miles.

5. PRICING 

The amount agreed upon covers the photographer’s time, talent, proofing and editing. It also cannot be changed or altered by any means. The charges in this contract are based on Jason J. Aguilar’s current pricing at the time of booking. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.

6. EXCLUSIVE PHOTOGRAPHER 

It is understood that no other photographer, amateur or professional, shall be allowed to photograph at the session near the photographer while he is working due to reasons of the photographer delivering the quality of images as expected. Any breach of this agreement can constitute a reason for non-completion of the job with no liability to the photographer.

 

7. FINAL IMAGES 

Jason J. Aguilar will choose the best images and videos from the engagement session and wedding day. Jason J. Aguilar does not show un-edited images or unused raw footage, nor involve my clients in the process of choosing which images or videos will be chosen for the final gallery/highlight. Jason J. Aguilar spends a great deal of time going through each image and footage individually. Please rest assured that Jason J. Aguilar will only show you the BEST of the BEST and any images that are unappealing (i.e.: eyes closed, unflattering facial expressions and most definitely, any images that do not meet my high professional standards) will get deleted. 

 

8. IMAGE DELIVERY 

The wedding images will be displayed in a password-protected online gallery within 2 to 3 weeks of your wedding day. The final highlight video and compilation of the raw video will delivered in Full HD in MP4 format in an USB Flash Drive within 4 weeks of your wedding day. The online gallery will be available for 6 weeks. If you wish to download the images, please do it in that time frame. Please allow up to 1 week for delivery of print release USB flash drive or SD Card.

9. COPYRIGHT AND OWNERSHIP 

It is illegal to copy or reproduce these photographs elsewhere without Jason J. Aguilar’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. All photographs and videos, both on Jason J. Aguilar’s website, blog or Facebook page, including all potential proofs and purchased prints, are copyrighted; reproduction of any image or video by any means, including copying, re-printing, screen captures, and other means of print reproduction are strictly prohibited and are a violation of copyright law. Additionally, it is ILLEGAL to use any of Jason J. Aguilar’s work for commercial or marketing purposes without the express permission of the photographer. The only exception to this is if you have purchased the print release for commercial use. 

 

10. USE OF FINAL IMAGES 

The client may publish the final images and highlight video for personal use on their social media, but as an artist, Jason Aguilar wishes to have control over the final look of his client’s images. Using filters over an already edited image and color graded video or scanning images could damage Jason Aguilar’s reputation as a photographer by distorting and devaluing the image or video quality. Thank you for respecting Jason Aguilar’s work and livelihood by choosing not to re-edit his images and videos.

 

11. FOOD AND ITERINARY 

An itinerary must be provided to the photographer before the wedding. For weddings longer than 8 hours, at least one plate of food must be provided at the reception for the photographer and assistant or second shooter.

 

12. CANCELLATION 

Jason J. Aguilar will not be held liable for services not rendered. To receive a full refund, Jason J. Aguilar must be notified at least 30 days before the wedding day; if not, Jason J. Aguilar will get to keep the deposit that has been paid for up until that point. Jason J. Aguilar also has 30 days to refund the money upon receiving notification that the wedding was cancelled.
