TERMS & CONDITIONS

1. GENERAL TERMS FOR VIDEOGRAPHY

This agreement constitutes an order for wedding videography services, including the recording and production of wedding video footage as agreed upon by both parties. All video footage, preview clips, highlight films, and related materials remain the intellectual property of Jason J. Aguilar, hereinafter referred to as the “Videographer.”

The Videographer retains the right to use selected footage for portfolio display, advertising, website, social media, and promotional purposes, unless otherwise agreed in writing.

This signed contract constitutes an agreement for videography services delivered in 4K high-quality digital video format (MP4). This document represents the entire agreement between the Videographer and the Client, and no other oral or written agreements shall be considered valid unless included in this contract.

2. LIMIT OF LIABILITY

If the Videographer is unable to perform the services outlined in this agreement due to illness, injury, emergency, natural disaster, terrorism, government restrictions, or any other cause beyond the control of the parties, the Videographer shall return all payments received and shall have no further liability with respect to this agreement.

The Videographer shall not be held liable for the loss or damage of photo or video materials due to camera malfunction, equipment failure, corrupted files, processing errors, or other unforeseen technical issues, except that liability shall be limited to the amount paid under this contract.

The Client acknowledges that a wedding is a live event that cannot be recreated or repeated, and therefore agrees that the Videographer’s liability is limited to the amount paid for services rendered.

3. RESERVATION DEPOSIT & PAYMENT SCHEDULE

A non-refundable reservation deposit equal to one-third (1/3) of the total package cost is required to secure the wedding date and time. No date will be reserved until the deposit has been received and this agreement has been signed. The reservation deposit is non-refundable under any circumstances, as the Videographer reserves the date exclusively for the Client.

A second payment of one-third (1/3) of the total package cost is due at the time of the engagement session or no later than one (1) month prior to the wedding date, whichever comes first. The remaining balance must be paid on or before the wedding date. Services may be withheld until the final balance has been paid in full.

4. TRAVEL FEE

Travel within 30 miles of Sanford, North Carolina is included.

Portrait sessions located beyond this distance will incur a $40 travel fee for up to 60 miles, and $60 for locations beyond 60 miles.

5. PRICING

The total amount agreed upon in this contract covers the Videographer’s time, talent, editing, and post-production services required to deliver the final video products. The pricing listed in this agreement is based on the Videographer’s current rates at the time of booking and is locked in for the services outlined in this contract. These rates will not change once this agreement has been signed.

The Videographer’s price list may be updated periodically. Any additional services, products, or future orders not included in this agreement will be charged according to the Videographer’s current pricing at the time the order is placed.

6. EXCLUSIVE VIDEOGRAPHER

The Videographer shall be the exclusive videographer retained for the Event. No other videographer, whether professional or amateur, may record video in a manner that interferes with, obstructs, or competes with the Videographer’s work. This provision is necessary to ensure the Videographer can deliver the expected quality of coverage.

If any individual’s actions interfere with the Videographer’s ability to perform the services agreed upon, the Videographer will not be held responsible for missed footage or reduced coverage resulting from such interference.

7. FINAL VIDEOS

The Videographer will review and select the footage from the wedding day at their sole artistic and professional discretion. The Videographer does not provide unedited images, raw footage, or unused materials, nor are Clients involved in the selection process for the final deliverables.

The Videographer carefully reviews all captured content and selects the footage and images that best represent the event and meet the Videographer’s professional and artistic standards. Materials that do not meet these standards—such as those affected by closed eyes, test shots, motion blur, duplicate frames, or other technical or aesthetic issues—may be excluded from the final delivery. All final videos and galleries will represent the best selection of the captured content as determined by the Videographer.

8. ARTISTIC STYLE

The Client acknowledges that they are familiar with the Photographer/Videographer’s portfolio, style, and editing approach, and agree that the final photographs and videos will be consistent with that artistic style and professional judgment. Creative decisions regarding editing, color grading, composition, and presentation are made at the Photographer/Videographer’s discretion.

9. VIDEO DELIVERY

Preview clips or still images may be delivered through a password-protected gallery if applicable within 2 to 4 weeks after the wedding date. The gallery will remain available for six (6) weeks, during which time the Client may download the images. Clients are responsible for downloading and backing up their images within this timeframe.

The final highlight video and a compilation of the recorded footage will be delivered in 4K resolution in MP4 format on a USB flash drive within four (4) weeks after the wedding date.

While the Videographer records in 4K quality, the final delivery format and compression settings are determined by the Videographer to ensure optimal playback compatibility and file quality.

10. COPYRIGHT AND OWNERSHIP

All videos, footage, and media created by the Videographer remain the copyrighted property of Jason Aguilar in accordance with United States Copyright Law.

The Client receives a personal-use license to share and display the final videos for personal purposes. The videos may not be sold, altered, or used for commercial purposes without written permission from the Videographer.

11. USE OF FINAL MEDIA

The Client is granted permission to use, share, and publish the final photographs and highlight video for personal, non-commercial purposes, including on personal websites and social media platforms.

To preserve the integrity of the Photographer/Videographer’s artistic work, the Client agrees not to alter, edit, apply filters, crop, scan, or otherwise modify the delivered images or videos. Any modification that changes the original appearance may misrepresent the Photographer/Videographer’s work and is therefore not permitted without prior written consent.

The Client agrees that all images and videos will be shared in their original delivered form.

12. EVENT SCHEDULE & MEALS

The Client agrees to provide the Videographer with a wedding day itinerary or timeline prior to the event to ensure proper planning and coverage.

For events with coverage exceeding eight (8) hours, the Client agrees to provide one vendor meal for the Videographer and any assistant or second shooter during the reception. The meal should be served at approximately the same time as the wedding party or guests so that coverage of key moments is not interrupted.

13. CANCELLATION & RESCHEDULING

If the Client cancels the event, the Videographer must be notified in writing. To receive a refund of payments made (excluding the reservation deposit), the Videographer must be notified at least 30 days prior to the scheduled wedding date. If cancellation occurs within 30 days of the event, the Videographer will retain any deposit paid up to that point.

If the Client requests to reschedule the event, the Videographer will make reasonable efforts to accommodate the new date. If the Videographer is available, all payments made will be transferred to the new date. If the Videographer is not available on the requested date, the change will be considered a cancellation, and the cancellation policy above will apply.

The Videographer will issue any applicable refunds within 30 days of receiving written notice of cancellation.

14. ARCHIVING
The Videographer will store final delivered files for up to 12 months after delivery. After this period, the Videographer is not responsible for archiving or maintaining backup copies of the Client’s media.

15. COOPERATION & VENDOR RESTRICTIONS

The Client acknowledges that the Videographer’s ability to capture certain moments, lighting conditions, or audio recordings may be limited by rules or restrictions imposed by venues, officiants, DJs, coordinators, or other vendors.

In some situations, there may be limitations on lighting, camera placement, movement during the ceremony, or access to the venue’s audio system or DJ soundboard. If access to the audio system is restricted or denied, the Videographer will make reasonable efforts to capture audio using alternative recording methods; however, the Videographer cannot guarantee optimal audio quality under such circumstances.

The Client understands that these restrictions are outside the control of the Videographer and may affect the final video product. The Client is encouraged to inform the venue, officiant, and DJ in advance that the Videographer may request access to the sound system or audio output for recording purposes. The Videographer shall not be held responsible for missed or compromised footage or audio resulting from such restrictions.
